SUBMITTAL REQUIREMENTS FOR LAND DEVELOPMENT
Planning Commission Meeting
- Submittal Deadline - the last Monday of month preceding the
meeting.
(Planning
Commission meetings are held the 2nd Monday of each month)
- Submittals must include the following:
- Developers Agreement –
signed and notarized DOWNLOAD
- Developers Escrow - established
- Signed & Notarized Subdivision or Land Development Plan (2
mylars & 6 prints)
- Erosion & Sedimentation Plan – with proof of submittal to
ECSCD
- Stormwater Management Plan – with calculations & schedules of
values
- Greenspace Plan
- Sewage Facilities Planning Module
- Highway Occupancy Permit
(plans and application to PaDOT or Summit Township, as applicable)
Supervisor’s Meeting
- Submittal Deadline – Thursday prior to meeting
(Supervisor’s meetings are held the 1st
& 3rd Monday of each month (7:30 p.m. & 4:30 p.m.)
- The following must be accomplished:
- Plans reviewed & signed by Township Planning
Commission & Erie Co. Planning
- Erosion & Sedimentation approval letter provided to Township
- Stormwater Agreement - signed & notarized
- Stormwater Financial Security – established
- Greenspace Plan - approved
- All (Township Engineer) plan review comments addressed
- Sewage Facilities Planning Module – Resolution & Transmittal

- Issuance of Highway
occupancy Permit from PaDOT or Township as applicable. A completion
acknowledgement for all improvements required under the PaDOT
Highway Occupancy Permit or Township Driveway Permit will be
required prior to

Statewide
Building Code Is Now In Effect
On July 6, 2004 the Summit Township Board of
Supervisors voted to “opt out” of the administration of the Uniform
Construction Code (UCC). This
simply means that Summit Township will defer to the Pennsylvania
Department of Labor & Industry (L & I) for plan review, issuance
of building permits and inspection of all commercial construction.
Plan review, building permits and inspections for residential
construction will be administered through third party inspection agencies
certified by L & I. Opting
out doesn’t mean that the UCC will not be enforced in Summit Township.
The UCC became effective in Summit Township on August
4, 2004 which is the date L & I was notified by certified mail of the
Township’s decision. As
such, no more “grandfathered” permits can be issued by the Township
that would exempt residents or businesses from adhering to UCC
requirements.

If a property owner does not get permits as required by the UCC and
Summit Township is made aware of this oversight, L & I will be
notified to investigate for possible prosecution. |
The new
permit process for residential construction will be as follows:
- Pick-up
a list of certified third party agencies from the Zoning Office. It is up to the resident to select a third party agency to do their plan review, issue a building permit
and perform inspections. (This selection might be based upon response time, cost comparison, location
of agency office, etc.)
IMPORTANT NOTE: All costs
associated with the third party agency fees will be paid by resident
directly to the third party agency that they have selected.
- Once
a third party agency is selected, the resident must come back to the
Zoning Office to obtain a “zoning permit” which confirms that the proposed structure is in
compliance with Summit Township’s Zoning Ordinance.
The third party agency selected by the property owner will be
noted on this permit.
- After
the zoning permit is secured, it should be taken to the selected third
party agency for plan review and building permit issuance.
- Construction
may only begin after the building permit is secured and arrangements
are made between the resident and third party agency for required inspections.
Third party agent will sign-off on each inspection as it is
completed.
- When
construction and inspections have been completed, third party agency
will issue an occupancy certificate.

A copy of the building permit, inspection report and
occupancy certificate issued by the third party agency must then be
brought back to Summit Township Zoning Office where a final Summit
Township Occupancy Certificate will be issued to document compliance with
the UCC and file will then be closed.
IMPORTANT NOTE: New
structure/addition may not be occupied until the Summit Township
Occupancy Permit is secured! Violations
will be investigated by the Summit Township Code Enforcement Officer
and may result in fines of up to $500.
Thankfully, the UCC was recently amended by Act 93 of
2004 signed into law by Governor Rendell on July 15, 2004. The new act amends the UCC to EXCLUDE repairs and nonstructural alterations to existing residential
structures from compliance with the UCC.
This is good news as it will exempt repairs such as replacing a hot
water tank or replacing a roof (as long as no structural alterations such
as adding dormers, etc. are made). New residential construction, including
additions to existing homes, must comply with the UCC.
"Addition" is defined as an extension or increase in floor area
or height of a building or structure.
Another
important aspect of the amendment is that it raises the exemption for
utility and miscellaneous structures (i.e. garage, storage building, etc.)
to 1,000 square feet. Any
structure of this type that is over 100 square feet but less than 1,000
square feet will simply require a zoning permit and will not be subject to
the UCC. Any structure less
than 100 square feet will not require permits but must meet proper zoning
setbacks.
Unfortunately, it will no longer be possible to obtain
a building permit “on the spot” so please plan your projects
accordingly. While the UCC
may seem very confusing to all of us, we will work diligently to assist
our residents in understanding the new process.
